BREEDING AGREEMENT
This agreement, made and entered into this _______day of________, 2006, by and
between Cassandra Adams herein after referred to as "stallion owner",
and_______________________________ hereinafter referred to as "mare owner":
In consideration of the mutual covenants and obligations herein expressed, and
good and valuable other consideration, IT IS HEREBY AGREED AS FOLLOWS:
1). Stallion Services The stallion owner agrees to provide, and the mare owner
agrees to purchase the breeding services specified in the agreement, subject to
the terms and conditions set forth below, and to pay the specified fees
therefore. The breeding services are to be provided during the season of

MARE SHALL FURNISH A NEGATIVE CURRENT GOGGINS TEST ,
NEGATIVE UTERINE CULTURE AND HEALTH CERTIFICATE ,
PROOF OF IMMUNIZATIONS IMPORTANT IN THIS AREA ,
AND SHE SHOULD DE DEWORMED WITHIN THE LAST SIX WEEKS
2). Payment of board for live cover: The stallion owner shall provide normal
customary care and feeding of the mare for which the mare owner agrees to pay a
daily fee of $10.00 for board. This amount shall be $15.00 per day for a mare
with a foal.
3). Obligations of the mare owner: The mare owner agrees as follows:
a). That the arrival of the mare will be coordinated with the stallion owner so
as to provide that the mare arrives approximately one week before going into
heat; we will not allow daily trailering in and out of the mare for breeding.
She must remain on the farm until breeding is complete.
b). That upon arrival, the mare owner will have had hind shoes removed from the
mare, will have a certificate indicating current coggins test and negative
uterine culture, and will be accompanied by health and shot records.
c). To pay all customary and veterinary expenses incurred by the stallion owner
in checking the mare's breeding condition and/or in treating the mare for injury
or disease, or the mare owner may have the mare's usual vet come to the farm for
the same.
4). Required Testing: In the event the mare should be boarded with the stallion
owner for a period of less than 30 days, the mare owner agrees to provide the
stallion owner with evidence of:
a). An ultrasound pregnancy test performed by a licensed veterinarian on the
18th day following the mare's last day of contact with the stallion, and;
b). A pregnancy test performed by a licensed veterinarian between the 40th and
45th day following the mare's last day of contact with the stallion.
c). Certified results of said tests are to be delivered to the stallion owner
within 48 hours of each said test. The mare owner agrees to be responsible for
the payment of all expenses and fees associated with such testing and to hold
the stallion owner, its officers, agents and employees harmless there from. By
not performing these tests and sending the results to stallion owner, the mare
owner nullifies this contract and will not be offered the return privilege or
the live foal guarantee.
5). Live foal: While the stallion owner can not guarantee the mare shall produce
a live foal, the stallion owner does agree that should said mare prove barren or
the foal die at birth, the mare owner shall send notice signed by a licensed
veterinarian within one week of such determination or death, and said mare owner
shall be furnished breeding services for the following season only. If by AI,
then mare owner also agrees to pay for collection fees and shipment of semen.
The mare owner may rebreed the same mare, or may breed another mare. In the
event the mare owner elects to exercise this re-breeding privilege, the mare
owner agrees to pay the normal and customary board fees in effect the following
season, if the mare is to stay at the breeding farm. It is expressly understood
and agreed that beyond the re-breeding privilege set forth in this paragraph,
there is no warranty, either express or implied, concerning delivery of a live
foal. If the mare has been with the stallion less than 45 days and if, after
testing, it is established the foal is not the get of this stallion, then in
that event, the mare owner shall not be entitled to the re-breeding privilege
set forth in this paragraph.
6). Fees: For the breeding services specified in this agreement, the mare owner
agrees to pay the stallion owner a breeding fee of $__________, and a
non-refundable booking fee of $.___150.00___Any additional board or other fees
shall be paid before the mare may leave the farm.
7). Liability for injury, death or disease: The mare owner shall not be liable
for the injury, death or illness of the stallion while engaged in activities
pertaining to breeding or the collection of semen from the stallion to be used
by the mare. In recognition of the risks inherent in breeding operations, the
stallion owner agrees to perform his services in the usual and customary
fashion, but shall not be responsible for the injury, death, or illness of the
mare and/or her foal.
The mare owner is urged to obtain appropriate insurance. The failure of the mare
owner to obtain appropriate insurance shall not, in any fashion, act to transfer
the liability for the injury, death, or illness of the mare, and/or her foal to
the stallion owner. The mare owner does, therefore, agree to hold the stallion
owner, its officers, agents, and employees, harmless from any and all liability
for the death, injury or illness of the mare and/or her foal.
8). Inability of the stallion to perform: In the event that it should be
established by competent authority that the stallion is unfit or unable to
perform in the proscribed fashion, this agreement shall be deemed to be
affirmatively terminated, and the breeding fee, less the non-refundable booking
fee, shall be refunded to the mare owner. There shall be no refund of the board
fees, shipping fees, vet fees, deposits, or collection fees.
9). Enforcement: Each and every term and condition of this agreement shall be
deemed to be material. Time is of the essence. Should it be necessary for one
party to seek to enforce the terms and conditions of this agreement in a Court
of Law, the prevailing party shall be entitled to an award of reasonable
attorney fees and costs.

PROCEDURE FOR THE TRANSPORTED SEMEN SYSTEM
WHAT MUST THE MARE OWNER DO?
1. Complete the Breeding Agreement and the Transported Semen Agreement. Return
both Agreements to Dragon Valour Farm along with:

Semen will not be shipped until both signed Agreements and $_________total of
for above is received. A copy of each Agreement will be returned to you.
2. Enclose at least two photos of your mare: one side view, one front view, and
if available, one action shot, or if you have a video that would be acceptable.
3. Let us know what month you would like to start breeding your mare. A good
rule of thumb - your mare will start ovulating regularly when she has shed her
winter coat. Due to the demands of the show ring, mare owners must coordinate
their mare's cycle with the availability of semen.
4. Make sure your vet is currently performing reproductive work that includes
artificial insemination with transported semen. Ask your vet if he/she has read
the Veterinarian Handbook published by Hamilton Systems.
5. Make sure you have some method to determine when your mare is coming into
heat, teasing your mare with a nearby old gelding or stallion that she will show
to is an important 5 minute procedure that can save both time and money.
WHAT HAPPENS NEXT?
1) Procedure for ordering Fresh Cooled Semen:
Order fresh cooled semen the 48 hours before the collection day. Call Monday for
a Wednesday collection; this semen can be used for breeding on Thursday or
Friday. Call Tuesday for a Thursday collection; this semen can be used for
breeding on Friday or Saturday. Call Wednesday for a Friday collection, this
semen can be used for breeding Saturday or Sunday.
2. Dragons Valour Farm will then make PRELIMINARY arrangements to ship the semen
overnight through Fed Ex will deliver to the address of your choice or counter
to counter.
3. You must contact Dragon Valour Farm 48 hours prior to the day the shipment of
semen must be made. We will not ship semen on 24 hours notice. We will not
guarantee timely shipment of semen if this call is not made!
4. You will be shipped the container of cooled semen overnight or it can be
picked up at the farm. Your vet should inseminate your mare with semen as soon
as it arrives.
5. If there is any question about the condition of the semen, have your vet save
a control sample and inseminate the mare anyway!
6. If an Equitainer is used have an express delivery company pick up the
Equitainer immediately after the final insemination. It is best to return it by
2nd day rates in order to avoid late charges. It is the mare owner's
responsibility to insure the Equitainer is returned to Dragon Valour Farm within
the 5-day limit.
7. Have your vet ultrasound your mare 14 - 16 days after ovulation to determine
her breeding status.
WHAT IF MY MARE DOES NOT GET IN FOAL ON THE FIRST HEAT?
1. If your mare is not in foal, preparations can be made immediately to breed
her again on her next cycle. Due to the stallion's schedule, it is important to
call with these results IMMEDIATELTY in order to insure timely scheduling of her
cycle with the availability of semen.
2. If your mare fails to conceive after receiving semen for 2 cycles, you should
have your vet perform a breeding soundness exam and/or infuse your mare with
antibiotics during the third cycle insemination. We have achieved success on the
third cycle when these methods are used. The averages show that it takes 1.6
cycles to get a mare in foal. In most cases, only mares with breeding problems
go over 2 cycles. The successive cycle collection charge of $ 250,00 must be
received prior to the second and each additional collection, in advance.
REMEMBER: WE WANT TO SHIP VIABLE SEMEN IN A TIMELY MANNER, SO TO INSURE THE
SUCCESS OF GETTING YOUR MARE PREGNANT, PLEASE FOLLOW THESE INSTRUCTIONS!
TRANSPORTED SEMEN AGREEMENT
1. $____350,-_______deposit is required on Equitainer due prior to shipping
semen. Semen will not be shipped until deposit or purchase price is received.
You are responsible for return charges for shipping the Equitainer back to us.
Equitainer deposit will be refunded within 30 days of your notice to us that
your mare is pregnant.
2. $____15.00_____ per day will be deducted from the deposit if the Equitainer
and its contents are not returned within 5 days of the original shipment. It is
the mare owner's responsibility to make sure this deadline is met, not the
carrier company's. Equitainer must be returned in good condition, or deposit
will be withheld. Disposable containers can be kept by you.
3. $ 250.00 collection fee will be charged for every collection of semen. This
fee is in addition to the breeding fee, the booking fee and the Equitainer
deposit/disposable container price, although it can be deducted from your
Equitainer deposit until this fee has been used up. Successive cycle shipments
will not be made until this fee is received prior to every collection necessary.
4. 100% of the breeding fee is due and payable prior to the initial request for
transported semen to be shipped. Semen will not be shipped until all necessary
fees are received.
5. The mare owner must contact Dragon Valour Farm to schedule the mare's
breeding cycle with the stallion's availability. The mare owner must contact
Dragon Valour Farm on the mare's FIRST day of heat, and again 48 hours prior to
the time semen needs to be shipped. Semen will not be shipped if both of these
contacts are not made appropriately.
7. All live foal guarantees will be null and void if the terms of this agreement
and the breeding contract are not fully executed. Please make a copy of this
